Tellmi Terms of Use 

This version of our Terms of Use is effective from 18th August 2022. 

1. Welcome to Tellmi

The tellmi.help website and the Tellmi service, including all Tellmi applications  (collectively referred to below as our “Apps”) are owned by Tellmi, a company registered in England and Wales with company number 09764411 and its registered address at The Health Foundry, 1 Royal Street, London, SE1 7LL (“we / Tellmi”). By using any of our Apps, or any services provided through them, you are agreeing to be bound by these terms and conditions ("Terms of Use"). These Terms of Use may be updated by us from time to time. We will notify you (for example, by email or through our Apps) before we make material changes to these Terms of Use, unless the changes are required by law. Once any updates to our Terms of Use are in effect, they will apply to you if you continue to use our Apps.

2. Basic Terms

  1. You must be 11 years or older to use Tellmi.

  2. You are responsible for any activity that occurs under your screen name (your username) including direct submissions to us.

  3. You are responsible for keeping your password secure.

  4. You must not post anything on our Apps that identifies, or is likely to identify, you or any other person. In particular, and without limitation, you must not share any phone numbers, home addresses, e-mail addresses or other personal information on any parts of our Apps that are visible to other users.

  5. You will use our Apps for educational purposes only. You will not make critical decisions based on feedback or advice from the Tellmi community or experts in the Tellmi community.

  6. You may not post offensive, abusive, indecent, obscene, libellous, defamatory, menacing or harmful content.

  7. You must not abuse, harass, threaten, impersonate or intimidate other users or use another person’s account to gain access to our Apps.

  8. You must comply with all applicable laws while using our Apps and you must not use our Apps for any illegal or unauthorised purpose. 

  9. You will not distribute or post spam or other unauthorised commercial communication on or through our Apps.

  10. You must not use our Apps in any way so as to bring us or any other party into disrepute.

  11. You must not modify, adapt or hack our Apps or modify another website so as to falsely imply that it is associated with Tellmi.

  12. You must not attempt to gain unauthorised access to our Apps, the server on which our Apps are stored or any server, computer or database connected to our Apps, or attempt to circumvent any security measures that are in place for our Apps. You must not access the private API for any of our Apps by any means other than via the relevant application itself.

  13. You must not crawl, scrape, or otherwise cache any content from our Apps including but not limited to user profiles, posts and replies.

  14. You must not misuse our Apps by introducing any worms or viruses or any code of a destructive nature.

If you notice any user acting in violation of these rules, please report this immediately to our system administrators via our contact form

We reserve the right to remove content and/or delete your account at our discretion, including if you violate any of these Terms of Use.

3. Services

The services provided by our Apps (“Services”) are mainly the following “General Information Services”:

  • a general information service in the field of mental health, wellbeing for personal and social issues;

  • a directory and signposting for specialist support services;

  • written articles and information concerning mental health and wellbeing,

and the following peer network service:

  • a peer support framework for users to share problems, ideas, experiences, support and solutions with other peers or super-peers (collectively referred to as “User Content”).

It’s currently free to register for Services, although the cost of connecting to the Internet is the responsibility of users. However, we reserve the right to charge subscription fees for Services, subject to prior approval by users.

Services are not a substitute for consultation with competent health professionals. Users should never, as a result of information read via our Apps, neglect or fail to seek the medical advice of their doctors or of other qualified professionals responsible for their healthcare. It is important to note that we cannot assess the health of individual users using the data they submit via our Apps. In an emergency, users should contact their doctor immediately or call an emergency number such as 999.

Although we make reasonable efforts to regularly update information distributed via our Apps as part of the General Information Services (as distinct from User Content posted or otherwise shared by users), such information is strictly indicative and general in character and cannot be perfectly error-free. The online tools available to users do not in any way constitute a medical device nor an act of telemedicine. Tellmi does not verify or control the content or suitability (including scientific, medical or health plans) of data entered by users. We do not endorse or recommend any specific methodology, advice or procedure, health profession, products or service that may be mentioned on our Apps. Users and third parties use information provided via our Apps at their own risk. 

4. Moderation and monitoring

All User Content is moderated before going live on Tellmi. The purpose of moderation is to:

  • reject content that doesn’t meet our Terms of Use and Moderation Guidelines; and

  • monitor content for safeguarding concerns.

By using Tellmi, you acknowledge and agree to our monitoring as described in these Terms of Use and on Tellmi. Although we endeavour to be rigorous in our moderation, the process cannot always be error-free nor take into account every user’s personal views and beliefs. Tellmi may contain material that you find explicit or offensive posted by users. Please exercise caution when using our Apps for yourself or if authorising the usage for others. We are not responsible for any direct or indirect exposure to explicit content.

If you get asked questions that make you feel uncomfortable, please ignore them or report them to the system administrators. Please do not engage in conversations with people that make you feel uncomfortable in any way.If you are harassed in any way, please report it to our system administrators or other appropriate authorities immediately.

Please note that if we become aware of any incidents of cyberbullying or consider that any individual is likely to cause harm to themselves or other people, we may contact you about our concern or report such incidents to the appropriate authorities or social workers at our sole discretion.

5. Users and SuperPeers

We use the services of paid and volunteer third-parties to act as ‘SuperPeers’ on Tellmi. While we take care to select individuals that we believe will make a valuable contribution to the Tellmi community we do not endorse their individual views and advice. You should not feel under any obligation to follow the advice of any other user or SuperPeer. Any such dealings are solely between you and such individual. To the maximum extent permitted by law, we shall not be responsible for any damage or loss incurred as a result of any such dealings.

6. Communication

In accordance with our Privacy Policy, we may contact you via email or through our Apps directly to your device regarding administrative issues, including improvements to our Apps. In addition, Tellmi may send you emails with content from the Tellmi community, such as our newsletters or with suggestions for specific support services that we think might be useful for you; you may opt out of receiving such communications at any point by clicking on the “unsubscribe” links in any of our emails.

7. Personal use only

Our Apps are for your personal use only and shall not be used by you directly or indirectly in connection with any academic, commercial or governmental endeavour. If you would like to advertise, conduct market research or other survey or research activities for academic, commercial or political purposes please contact us.

8. Privacy

Please read our Privacy Policy for information about how we process and protect your personal data.

9. Advertising and sponsorship

We may enable third parties to provide information or advertise their products and services or may otherwise describe certain third party services. Any such content shall not be considered an endorsement by us of such products or services, and we shall not be liable for: (i) your interactions with any entity and/or individual on or through our tools, including but not limited to interactions involving the payment and delivery of goods and services, or (ii) any other terms, conditions, warranties or representations associated with such dealings. Any such dealings are solely between you and such entity and/or individual. To the maximum extent permitted by law, we are not responsible for any damage or loss incurred as a result of any such dealings.

We validate each new advertiser or sponsor systematically and reserve the right to refuse advertising if its contents could be controversial or if our team considers that it fails to promote improvements to mental health and wellbeing. Decisions are made independently of any commercial or advertising influence. All adverts and sponsored content are clearly identified.

10. Copyright and Trade Mark Ownership

You own all the content you post on Tellmi and grant us a perpetual, non-exclusive, transferable, royalty-free, sub-licensable, worldwide licence to collect, host, reproduce, publish, distribute, display, transmit, modify and otherwise use your posted content on Tellmi (in accordance with our Privacy Policy and your application settings). 

Ownership of any materials that you submit directly to us for use on Tellmi, for example images for our educational resources, will transfer to us on acceptance of the material. We are under no obligation to pay you for submitted materials without prior agreement.

Aggregated and compiled content available through Tellmi is the property of Tellmi or its licensors and may be protected by English and/or international intellectual property laws. The collection, arrangement and assembly of all content is the exclusive property of Tellmi and protected by English and/or international intellectual property laws. We grant you permission, subject to the rules and restrictions set out in these Terms of Use, to share this information via provided utilities (i.e. Facebook), electronically copy, and print copies of content for personal use only. Any other use, including the reproduction, modification, distribution, transmission, republication, or display of the content is strictly prohibited. If you use material other than as permitted by these Terms of Use, you may be liable for infringement, misappropriation or other causes of action to the fullest extent of the law.

You must not post media (images, text, video, audio, or other) on our Apps unless you have full ownership/rights in such media or are otherwise legally permitted to do so.Other than the personal use licensed above, you may not reproduce any content in any form without first obtaining written permission.

All trade marks, logos, service marks and trade names are proprietary to Tellmi or third parties who have granted Tellmi the right or licence to use such intellectual property. Tellmi does not grant, by implication or otherwise, any licence or right to use any trade mark, service mark, trade name or logo displayed without our prior written consent.

11. Links to Other Sites

Our tools may contain links to other websites. The linked sites are not under our control, and we do not warrant, represent or assume any responsibility or liability for the accuracy or completeness of the information or software or other materials downloaded from or contained in any linked site or any site contained in a linked site.

12. Disclaimer, Warranties and Liability

Nothing in these Terms of Use is intended to exclude or limit our liability for death, personal injury or fraudulent misrepresentation caused by our negligence, or to affect your statutory rights.The following limitations in this section apply to the maximum extent permitted by law.You acknowledge and agree that your use of our Apps is at your sole risk, and that you may only use our Apps for your own personal use.  None of Tellmi or our officers, directors, employees, agents, successors or affiliates will be liable to any user of our Apps or any other person or entity for any:

(a)           indirect, special, incidental, punitive, consequential or exemplary losses;

(b)           losses caused by events or circumstances outside of Tellmi’s reasonable control;

(c)           loss of profits, sales, business or revenue;  

(d)           loss or corruption of data; or

(e)           loss of use,

in each case, arising out of the use or inability to use Tellmi, even if we have been advised of the possibility of such losses.

For all losses you or any other person may suffer in connection with your use or inability to use Tellmi our liability will be limited to £100.

We disclaim all implied warranties of fitness for any particular purpose regarding Tellmi.

We accept no liability for advice provided by any medical professionals.

We cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data, settings, or other service interruptions. For this reason, Tellmi, including the services of our third-party service providers, are provided "as-is" and we do not guarantee the availability of Tellmi or that any of their features or services will be interrupted or error-free.

13. Law

At present, Tellmi is designed primarily for users resident in the United Kingdom and the Republic of Ireland. These Terms of Use are governed by English law and are subject to the exclusive jurisdiction of the English courts, except that if you live in Scotland you can bring legal proceedings in either the Scottish or the English courts, or if you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.

14. Notices

Except as otherwise stated, any notice to us shall be given by email to support@Tellmi.Help and any notice to you shall be given to the e-mail address that you provided to us during the account registration process. Notice shall be considered given the next business day after an e-mail has been sent.

15. General Conditions

  1. We reserve the right to modify or terminate all or part of Tellmi for any reason, without notice at any time.

  2. We reserve the right to refuse service to anyone for any reason at any time.

  3. We reserve the right to force forfeiture of any username that becomes inactive, infringes any intellectual property rights, or may mislead other users.

  4. We may, but have no obligation to, remove User Content and accounts containing User Content that we determine in our sole discretion is unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable or violates any intellectual property rights or these Terms of Use.

  5. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trade mark on those usernames.
